1. Acceptance of Terms

We are Maple Ridge LLC (“Company,” “we,” “us,” “our”), a limited liability company registered in Texas, United States at 5900 Balcones Dr Suite 100, Austin, TX 78731.

We operate the mobile application SmartStops - Road Trip Planner (the “App”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Maple Ridge LLC, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

2. Description of Service

SmartStops is a trip planning application that helps users plan routes, find points of interest, and manage travel itineraries. The service includes mapping, navigation assistance, location-based recommendations, automated trip planning (“Plan-It-For-Me”), route optimization, and recommendations for parks, restaurants, and other points of interest. Features and functionality may vary based on your subscription tier.

3. User Accounts

To access certain features of SmartStops, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions, Billing, and Refunds

SmartStops offers multiple subscription tiers (including Starter, Weekender, and Adventurer plans) with varying features and capabilities. Subscriptions are billed through your platform provider (Apple App Store or Google Play Store) and are subject to their billing terms and refund policies.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your platform account settings. Free trials, if offered, automatically convert to paid subscriptions unless canceled before the trial period ends.

Feature availability, limitations, and entitlements differ by subscription tier. This may include restrictions on the number of routes, cities, trips, or access to premium features such as automated planning. We reserve the right to modify subscription plans, pricing, features, and promotional offers at any time. Refunds are handled exclusively by Apple or Google according to their respective policies; SmartStops does not process refunds directly.

5. Acceptable Use

You agree to use SmartStops only for lawful purposes and in accordance with these Terms of Service. You may not use the service to violate any applicable laws, regulations, or third-party rights. You may not attempt to gain unauthorized access to our systems or engage in any activity that disrupts or interferes with our services.

6. Navigation and Safety

SmartStops provides navigation assistance and route suggestions for informational purposes only. Route suggestions, estimated arrival times, and traffic information are provided for informational purposes only and may be inaccurate, delayed, or incomplete due to changing road, weather, or traffic conditions. You are solely responsible for safe operation of your vehicle and compliance with all traffic laws. Always use your own judgment and follow local traffic regulations. Do not rely solely on the app for navigation in emergency situations.

7. Data Accuracy and Recommendations

SmartStops aggregates data from multiple third-party sources including OpenStreetMap, Radar, Foursquare, and other providers to offer recommendations for parks, restaurants, stops, and points of interest. We do not guarantee the accuracy, completeness, currency, or reliability of any data, recommendations, or route suggestions.

Information about locations, operating hours, amenities, safety, accessibility, and suitability is provided for informational purposes only and may be outdated or incorrect. We make no representations or warranties that any location is open, safe, appropriate, accessible, or suitable for your needs. You are solely responsible for independently verifying all information before visiting any location.

Our “Plan-It-For-Me” feature, route scoring, and automated recommendations are algorithmic suggestions based on available data and user preferences. These are not endorsements or guarantees of quality, safety, or suitability. Always exercise your own judgment when selecting destinations and routes.

8. User Responsibility and Child Safety

SmartStops is a planning and navigation tool only. It is not a child-safety service, supervision service, or childcare resource. Parents and legal guardians remain fully responsible for the safety, supervision, and well-being of children at all times.

References to “family-friendly,” “kid-friendly,” playgrounds, parks, or similar designations are informational only and do not constitute safety certifications or guarantees of suitability for children. You must independently assess and verify the safety and appropriateness of any location for your family's specific needs.

9. Location Data and Privacy

SmartStops collects and processes location data to provide routing, navigation, and location-based recommendations. By using SmartStops, you consent to our collection and use of location data as described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Intellectual Property

The SmartStops app, including its content, features, and functionality, is owned by SmartStops and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without prior written consent.

11. Third-Party Services

SmartStops integrates with third-party services including OpenStreetMap, Radar, Foursquare, mapping providers, fuel price databases, and point-of-interest information. We are not responsible for the accuracy, availability, reliability, or content of these third-party services. Your use of such services may be subject to additional terms and conditions imposed by those providers.

12. Limitation of Liability

SmartStops is provided “as is” without warranties of any kind. We do not guarantee the accuracy, completeness, or timeliness of information provided through the service. In no event shall SmartStops be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

13. Service Availability and Feature Changes

We strive to maintain service availability but do not guarantee uninterrupted access to SmartStops. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, discontinue, add, or remove features at any time without notice. This includes but is not limited to: changing subscription tier features, adjusting feature limitations (such as route limits, city limits, or trip restrictions), removing or modifying experimental or beta features, and altering algorithms or recommendation logic. Feature availability is not guaranteed indefinitely, and changes may occur without refunds or compensation.

Beta, experimental, or newly released features may behave inconsistently, contain errors, or be modified significantly based on user feedback and our ongoing development. Your access to specific features may change based on your subscription tier, promotional periods, or our business decisions.

14. Termination

We may terminate or suspend your account and access to SmartStops immediately, without prior notice, if you breach these Terms of Service. Upon termination, your right to use the service will cease immediately, and we may delete your account data.

15. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms in the app and updating the “Last updated” date above. Your continued use of SmartStops after such changes constitutes acceptance of the new terms.

16. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.

Any disputes, claims, or controversies arising out of or relating to these Terms or your use of SmartStops shall be resolved through binding individual arbitration in accordance with the American Arbitration Association's rules, conducted in Texas. You waive any right to participate in class actions, class arbitrations, or representative actions.

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in state or federal courts located in Texas to protect intellectual property rights or confidential information. You consent to the exclusive jurisdiction and venue of such courts.
